Do I Have to Wait Before Applying Again?
This is one of the first questions we are asked following a refusal. There is not necessarily a standard waiting period following every Builder Licence refusal outside of the Government processing times. Your position will depend on the reasons for the decision and your individual circumstances.
For some applicants, there may be matters that can be addressed relatively quickly. For others, further experience, qualifications, documentation or time may be required before another application should be considered. What we generally do not recommend is simply re-lodging the same application and hoping for a different result.
A refusal provides valuable information about how the licensing authority has assessed your application. That decision should be properly understood before determining your next step. You need to know in detail what has been accepted and what has not.
Why Are Builder Licence Applications Refused?
There can be many reasons….
The Building Commission NSW identifies circumstances that may result in a licence application being refused, including not meeting qualification or experience requirements, failing to provide requested information, insurance requirements, compliance history and fit and proper considerations.
For Queensland applicants, the same sort of reasons apply. The QBCC assesses applications against the eligibility requirements applying to the particular licence class. In our experience, Builder Licence refusals are not always as simple as having enough years in the construction industry. An applicant may have extensive industry experience but will still encounter difficulty demonstrating that their qualifications, experience and supporting evidence meet the specific licensing requirements.
This is where an independent review can be invaluable.
What Are My Options After a Refusal?
Depending on the circumstances, your options may include seeking an Internal Review of the decision, preparing a fresh licence application or allowing further time to address the matters that resulted in the refusal.
Internal Reviews are time sensitive. Both Building Commission NSW and the QBCC generally require an Internal Review application to be made within 28 days. An Internal Review requires the applicant to put forward the basis and supporting information for why the regulator’s original decision should be changed. It should not be treated as simply another opportunity to submit the same application.
For this reason, we approach Internal Reviews cautiously. In many circumstances, rather than trying to overturn an existing decision, the more practical strategy may be to step back, understand the reasons for refusal and consider whether a fresh, carefully prepared application can directly address the issues identified by the regulator, without the need to progress an Internal Review.
The appropriate pathway will depend on the refusal decision and your individual circumstances.
